The ongoing legal feud between Karisma Kapoor`s kids and Priya Kapur over the late industrialist Sunjay Kapur was seen turning fiery at the Delhi High Court on Tuesday, after Senior Advocate Mahesh Jethmalani launched an explosive attack on Priya. Sunjay and Karisma`s kids have filed a plea in court stating that his widow had forged his will and excluded them from being beneficiaries of his assets and inheritance.
Karisma Kapoor`s kids` lawyer`s argument about Sunjay Kapur`s will
Appearing before Justice Jyoti Singh, Jethmalani said, “The lady is an acute gambler, good luck to her,” while arguing on behalf of actor Karisma Kapoor’s children, Samaira and Kiaan Raj, who have questioned the will’s validity. Jethmalani informed the court that the document in question could not have been prepared, read, or approved by Sunjay Kapur, given what he described as “serious infirmities” in the drafting and execution of the will.
“When you get ‘she’ and ‘her’ wrong in four different places, a man like Sunjay Kapur, with his education and reputation, wouldn’t have signed it. A will with such errors would have ruined his reputation,” the advocate noted.
He also added that there was no proof Sunjay had drafted or even seen the will. “There’s no digital footprint; he is a digital ghost. He doesn’t appear physically, there’s no handwriting,” Jethmalani told the judge.
Errors in Sunjay Kapur`s will
During a hearing on Monday, October 13, the advocate had pointed out several mistakes in the will, including wrong addresses, misspelt names, and missing details about assets such as jewellery and cryptocurrency, calling them “completely uncharacteristic of Mr Kapur, who was always meticulous.”
“This will demean him. It`s careless, inconsistent, and goes against all circumstantial evidence,” Jethmalani submitted, noting that Mr Kapur`s properties in India were already secured under a tight family trust, making the will unnecessary.
The petitioners have alleged that Priya Kapur received more than 60 percent of the assets, while others were left with a much smaller share. “Those who forged the will benefited directly. Nitin Sharma became a company director just a day after the funeral,” Jethmalani said, adding that forgery of a will is punishable with life imprisonment.
He also claimed that the executor of the will was never informed of her appointment. “That is highly unnatural for someone as aware and educated as Mr Kapur,” he said.
Jethmalani urged the court to maintain the status quo on the assets, arguing that no third-party rights should be created until the authenticity of the will is proven.
