​Thane MACT awards Rs 46 lakh to family of man killed in 2017 road accident 

The Motor Accident Claims Tribunal (MACT) in Thane has awarded a compensation of Rs 46.55 lakh to the family of a man who died in a road accident over eight years ago, reported news agency PTI.

In its order dated February 26, a copy of which was made available on Wednesday, the tribunal directed the insurer to pay the amount first and recover it from the owner of the vehicle responsible for the fatal crash, reported PTI.

Pramod Namdev Naik (35) was travelling in a jeep when it collided with a “Hyva truck” being driven in a rash and negligent manner in Palghar district. MACT matters from the district are heard in neighbouring Thane, reported PTI.

Presiding tribunal member R V Mohite held that the truck driver did not even have a valid driving licence at the time of the accident. “The accident occurred due to absolute negligence on the part of the driver of Hyva vehicle,” the tribunal ruled, reported PTI.

Considering Naik`s monthly income of Rs 20,489 at the time, the tribunal awarded a compensation of Rs 46.55 lakh along with 9 per cent annual interest from the date of the petition till the amount is deposited, reported PTI.

As per the final order, Naik`s wife was awarded Rs 20.55 lakh, their minor son Rs 16 lakh, and his parents Rs 5 lakh each.

Thane MACT awards Rs 25.59 lakh compensation to kin of woman killed in accident

In another case, the Motor Accident Claims Tribunal (MACT) in Maharashtra`s Thane district has awarded a compensation of Rs 25.59 lakh to the family of a 28-year-old woman run over by a speeding tanker in 2016, reported PTI.

MACT member R V Mohite awarded the sum to the two minor children and the husband of the deceased, who was employed as a househelp, reported PTI.

A copy of the order February 25 was made available on Monday.

A speeding tanker ran over the victim, Surekha Yogesh More, while she was crossing the Bhiwandi-Kalyan road in Kongaon on May 8, 2016, reported PTI.

The tribunal noted that the tanker, driven in a “rash and negligent manner”, dashed into the woman and ran her over, killing her on the spot.

The Kongaon police registered an offence under sections 279 and 304(A) of the IPC against the driver.

The tribunal noted that the insurance policy was issued to the tanker owner after the accident.

It, however, directed the insurance company to satisfy the award and then recover the sum from the vehicle owner.

The claimants are entitled to a compensation of Rs 25.59 lakh, the tribunal stated, adding that the amount must be paid with interest of 9 per cent per annum from the date of the petition.
